Magic Lantern - FBI Key Logger

Magic Lantern is nothing more than a key logger, which is planted in a person's system via a Trojan; the reasoning behind the use of this software is that suspects are becoming smarter, and encrypting the incriminating evidence on their computers, and the email they send. The FBI wants to be able to log every keystroke on a person's computer and perform an analysis on the keystrokes to discover passwords, encryption keys, and the like. Magic lantern is nothing more than another virus; the FBI is now resorting to tactics of Scriptie Kiddies, using viruses and trojans to infect a person's computer(though im sure the code behind the Magic Lantern project will be more sophisticated than the average trojan). Anti-virus software can no doubt be written to combat this key logger, but the question is will it be written? McAfee has already declared that the new software will not be shown as a virus, or trojan... so much for consumer confidence. To me this is an invasion of privacy at the upmost level, it is installed ON the persons machine, so when the warrant for the use of the software is up, who is going to ensure that is no longer in use? and more importantly will a warrant even be need as with the Carnivore project? A FBI spokesperson has said that "Like all technology projects or tools deployed by the FBI it would be used pursuant to the appropriate legal process" and again will a warrant be needed?
